Contest Rules

VOID IN AZ, CT, MD, NJ, TN, VT, OUTSIDE THE UNITED STATES AND WHEREVER PROHIBITED. THIS CONTEST WILL BE CONSTRUED AND EVALUATED ACCORDING TO U.S. LAW.

  1. Entry Period: The Moen "Show Us Your Style" Contest ("Contest"), created by Moen Incorporated ("Sponsor"), begins for subscribers of the Moen "At Home" e-newsletter on July 1, 2008, and begins for all other registered members of the Show Us Your Style online community ("Online Community") on August 1, 2008 at 12:00:01 a.m. Eastern Time ("ET"). The Contest ends for all entrants on October 19, 2008 at 11:59:59 p.m. ET (start through end dates hereinafter the "Contest Period"), by which time all entries must be received. The computer clock of Sponsor's webmaster is the official timekeeping device of the Contest.

  2. Eligibility: Entry into the contest is open to legal residents of the United States and District of Columbia ("D.C.") (excluding residents of Arizona, Connecticut, Maryland, New Jersey, Tennessee, Vermont and all U.S. territories and possessions) who are 18 years of age or older (19 or older if a resident of AL or NE) at time of entry, and who are registered members of the Online Community at www.showusyourstyle.com as of date of entry. Although residents of the states listed above may not enter the Contest, they may participate in the "Public Voting" phase of the Contest; see Rule 4b., below. Subscription to Moen "At Home" is free; see http://www.moen.com/designcenter/athome/subscribe for details. Membership in the Online Community is free; see www.showusyourstyle.com for details. Employees, officers and directors of Moen Incorporated and Liggett Stashower ("Administrator"), their respective parent company, divisions, subsidiaries, and affiliates, and the agents and advertising and promotion agencies of each of the foregoing, and members of the immediate families (defined for these purposes as including parents, spouse, children, siblings, grandparents, and each of their respective spouses) or households (whether related or not) of any of the above, are NOT eligible to enter or win, but are eligible to vote (see Rule 4b., below). Residents of Arizona, Connecticut, Maryland, New Jersey, Tennessee, Vermont and all U.S. territories and possessions are NOT eligible to enter or win. By participating in the Contest, entrants agree to be bound by these Official Rules, the decisions of the judges, which are final, and the Terms and Conditions of www.showusyourstyle.com (see Web site for complete Terms). The Contest is subject to all applicable federal, state and local laws and regulations, and is void, with respect to entry, in Arizona, Connecticut, Maryland, New Jersey, Tennessee, Vermont, outside the United States and where prohibited by law.

  3. How to Enter: To enter: Log on to www.showusyourstyle.com (the "Web site") during the Contest Period to enter by following the onscreen instructions and those instructions contained in these Official Rules. By entering, you represent that you have read the Official Rules, the Web site policies and the Terms and Conditions of www.showusyourstyle.com and any special Terms and Conditions applicable to the "Show Us Your Style Contest", and that you agree to be bound by all of them. Using the entry method described above, each eligible entrant will be required to provide his/her name, age, zip code, telephone number and e-mail address, to answer a few short questions and to comply with the submission requirements listed below:

    1. Submit at least one (1) "after" photo of a kitchen, mini–kitchen (e.g., Morning Bar), bath or powder room in your own current residence that you remodeled yourself or with the help of a designer and/or contractor in a project that was completed after July 1, 2003 but prior to October 19, 2008 (the "Remodel"). The photo(s) should illustrate the thoughts expressed in your essay (see size/format requirements for photos in this Rule, below). You may also submit "before" and "during" photos of your Remodel (quality of these photos will not be considered in the judging process). No more than 15 photos may be submitted in total;
    2. Submit an essay of 250 words or less, in English, describing your remodeling goal and how you achieved it; and
    3. Submit tips and advice, in 250 words or less, in English, that you would give other home remodelers based on your remodeling experience.

    Follow the on-screen instructions at www.showusyourstyle.com to upload your "after" (and "before" and "during", if any) photo(s) and to submit your essay and tips/advice.

    Photo Requirements: Photograph(s) must be in color, cannot exceed 1 MB in size and must be in .jpg format.

    Limit one entry per person or e-mail address per Remodel project. If more than one entry is received for a particular Remodel project, only the first entry received per Remodel project will be included in the Contest; all other entries will be disqualified. Entries must be submitted by, and in the name of, one person or e-mail address. Proof that you uploaded and/or submitted photo(s), essay, and/or tips/advice to enter does not constitute evidence that we actually received them within the Contest Period. By entering, contestant represents that his/her submission (including photo(s), essay and tips/advice) is his or her original work; that the remodeled room that is the subject of the entry is a room in entrant's own current residence; that the submission and each portion thereof does not infringe on the property rights or other rights of any third party; and that the submission has not been submitted in any other contest, won any award in any contest nor been published previously. Modifying, enhancing or altering a third party's pre-existing work does not qualify as entrant's original creation. The Sponsor reserves the right to disqualify any submission that it determines (in its sole discretion) to contain any content that is obscene, defamatory, dangerous, discriminatory, infringing or otherwise inappropriate or unsuitable for publication to general audiences, or that contains any third party trademarks (other than those of Sponsor). All entrants must use caution and common sense in creating their entries.

    During the Contest Period but prior to the Public Voting Period (see Rule 4 (b), below), selected photos, essays and/or tips/advice may be posted on www.showusyourstyle.com. Such postings may be on a rotating or occasional basis and may be discontinued at any time at Sponsor's sole discretion. Posting of an entry at this phase of the Contest Period is not meant to indicate that the entry is a winner, provisional winner or Finalist in the Contest, or that it is otherwise favored in any way. Postings will occur solely for promotional purposes.

    All entries become the property of the Sponsor and will not be returned.

  4. Winner Selection Process: Eight (8) Finalist winners and one (1) Grand Prize winner will be selected in a three-step process, as described below:

    1. Initial Judging

      After the conclusion of the entry period, all eligible submissions will be reviewed by a panel of qualified judges based on the following criteria: creativity of design as demonstrated in "after" photo(s) (30%); achievement of goal expressed in essay (30%); originality of the Remodel (30%); and writing style (10%).

      The eight (8) top-scoring entrants based on the criteria described above will be deemed "Finalists" and will be notified by mail, telephone or e-mail, at Sponsor's discretion. In the event of a tie, the entrant with the highest score in the "creativity of design" criterion will be judged the "Finalist" (see full description of Finalist status below). In case of a tie involving a Wisconsin resident, both/all tied entries will be deemed "Finalists."

      Each Finalist will then be included in a Public Voting event, as described below.

    2. Public Voting:

      The Finalist submissions will be posted for public viewing and voting on www.showusyourstyle.com between approximately November 1, 2008 and November 15, 2008 (the "Public Voting Period"). Registered members of the Online Community may vote once for their favorite Finalist entry, subject to the terms and conditions of the www.showusyourstyle.com Web site and the voting instructions to be posted on the www.showusyourstyle.com Web site, including but not limited to, the following: voters must be legal residents of one of the 50 United States or D.C., members of the Online Community and at least 18 years of age as of the time of voting; and no more than one vote is allowed per registered Online Community member, person or e-mail address for the entire Public Voting Period. Votes that do not comply with the Official Rules or these requirements, or that result from fraud or collusion, may be disqualified in Sponsor's sole discretion. If a Finalist is found to have engaged in such fraud or collusion, in Sponsor's opinion, s/he will be disqualified as a Finalist and will not be eligible to win the Grand Prize in this Contest.

    3. Final Determination of Grand Prize Winner

      Following the conclusion of the Public Voting Period, all valid votes received by each Finalist will be counted.

      In order to determine the Grand Prize Winner, the judges will take into consideration the score each Finalist received in the Initial Judging phase and the number of valid votes each Finalist received during the Public Voting period. The following weights will be assigned to the judging score and vote totals: Judging Score – 60%; Vote Totals – 40%. On the basis thereof, the judges will declare the Grand Prize winner. In the event of a tie, the tied entrant with the highest score in the "creativity of design" criterion in the initial judging phase will be declared the Grand Prize winner. In case of a tie involving a Wisconsin resident, duplicate prizes will be awarded.

  5. Prizes: Finalist Prizes. Each of the eight (8) Finalists will be awarded one (1) One Thousand Dollar ($1,000) pre-paid Visa® gift card.

    Grand Prize. The Grand Prize winner will be awarded winner's selection of Moen® product from Moen's 2008 Kitchen and Bath collection print catalog, not to exceed a total value of One Thousand Dollars ($1,000), and Nine Thousand Dollars ($9,000) cash (awarded as a check). The Grand Prize winner must submit his/her Moen product order no later than January 31, 2009.

    Approximate Retail Value ("ARV") of all available prizes $18,000. Gift cards are subject to all terms, conditions and polices imposed by the issuer. No transfer or substitution of prizes or cash alternative (as applicable) permitted, except as provided herein. Sponsor reserves the right to substitute a prize of equal or greater value in the event the advertised prize is unavailable. All income taxes on prizes are the sole responsibility of the Winners. Winners will be issued IRS Forms 1099 for the value of the prizes. The prizes will be awarded provided a sufficient quantity of qualifying entries is received, and the prizes are claimed properly in accordance with these rules. As used herein, the term "Winners" includes the Finalists and the Grand Prize winner.

  6. Rights: By submitting an entry you warrant that each component thereof (photo(s), essay, tips/advice) is your wholly original creation and that no such component infringes any copyright, trademark, publicity, privacy or other proprietary right of any third party, union or guild. Entrants further warrant that they have received consent from anyone other than entrant who appears within the submitted photograph(s) for their inclusion in the Contest submission, and may be required to provide proof of such consent. Submission of an entry grants Sponsor and its agents the right to publish, use, adapt, edit and/or modify the entry in any way, in whole or in part, in commerce and in any and all media worldwide now known or hereinafter developed, without limitation and without notice or consideration to the entrant. By submitting an entry, each entrant in the Contest further agrees that his/her entry constitutes an assignment to Sponsor of all rights, title and intellectual property rights in and to all components of such submission as a condition of competing for a prize, including without limitation the right to make any derivative version of the entrant's submission (in whole or in part), and absolute discretion to alter the entrant's submission in any way, including without limitation editing, cropping, reformatting, title changes, and removal or addition of any element. Sponsor may require each Winner to execute documents to confirm this transfer of rights, or prize will be forfeited and an alternate winner selected based on the criteria stated herein.

    Entrants and/or anyone who appears within the submitted photograph(s) grant permission to Sponsor to use their submissions, any derivatives/portions thereof, names, likenesses, and biographical information for promotional or advertising purposes in all media worldwide, without notice or further compensation, unless prohibited by law. By participating, entrants hereby agree to release and hold harmless Sponsor, Administrator, their respective parent companies, affiliates, subsidiaries, and each of their respective directors, officers, shareholders, employees, agents, and advertising and promotional agencies (collectively the "Releasees") from and against any and all liability for claims, costs, injuries, losses or damages of any kind, (including, without limitation, claims, costs, injuries, losses or damages related to personal injuries, death, damage to, or loss or destruction of property, rights of publicity or privacy, defamation or portrayal in a false light) which may occur in connection with their participation in the Contest, use of the "showusyourstyle" Web site (including but not limited to damage to entrants' or others' computer equipment resulting from participation), their preparation for or participation in the Contest or preparation/posting of any submission, or from their acceptance, possession use/misuse of any prize they may be awarded.

    Winners agree to indemnify and hold the Releasees harmless from and against any claims, suits, losses, damages and expenses, including reasonable attorney fees, which arise in connection with any allegation that their submission violates the intellectual property rights of any third party, or in connection with any allegation based on rights of privacy or publicity, defamation or portrayal in a false light. Each potential Winner will be notified by e-mail, phone or postal mail and will be required to execute and return a Release of Liability and Publicity (where permitted) and Affidavit of Eligibility within ten (10) days of first attempted written prize notification or winner may be disqualified and an alternate potential winner selected based on the criteria stated herein. Any person appearing in a winning photograph may be required to execute a publicity/liability release or such winning entry may be disqualified.

    Additional important details regarding the rights of entrants and persons appearing in submitted photos are contained in the "Show Us Your Style" Contest Web site Terms and Conditions, to which entrants will be required to indicate their agreement before entering. Entrants must review the Terms and Conditions before entering.

  7. Entry Errors/Tampering: Sponsor is not responsible for: (i) electronic or digital transmissions or any entries that are lost, late, stolen, incomplete, illegible, damaged, garbled, destroyed, or misdirected; (ii) any problems or technical malfunctions, errors, omissions, interruptions, deletions, defects, delays in operation or transmission, communication failures, destruction or unauthorized access to, or alteration of, entries; (iii) failed or unavailable hardware, network, software or telephone transmissions, damage to entrants' or any person's computer and/or its contents, or causes beyond Sponsor's reasonable control that jeopardize the administration, security, fairness, integrity or proper conduct of this Contest; (iv) any entries submitted in a manner that is not expressly allowed under these rules; (v) incorrect or inaccurate entry information whether caused by entrants or by any of the equipment or programming associated with or utilized in the Contest, (vi) any typographical or other error in the printing or advertising of the offer, administration or execution of the Contest, or in the announcement of prizes/Winners; or (vii) malfunctions or interference resulting from illicit, malicious or injurious code (including but not limited to viruses, worms and denial of service attacks). If for any reason the Contest cannot be executed as planned, including but not limited to transmission failure, infection by computer virus, bugs, tampering, unauthorized intervention, fraud, technical failures, or any other causes beyond the control of Sponsor that corrupt or affect the security, administration, fairness, integrity or proper conduct of the Contest, or if the Contest is compromised or becomes technically corrupted in any way, electronically or otherwise, Sponsor reserves the right to cancel, modify or terminate the Contest and reserves the right, but shall not be obligated, to select the winners based on the initial judging step only from among all non-suspect entries received as of the date/time of such termination/cancellation or modification. Sponsor reserves the right, at its sole discretion, to disqualify and prosecute any individual who tampers with or attempts to tamper with the entry/voting process or who votes using any automatic or programmed entry duplication method.

    CAUTION: ANY ATTEMPT BY ANY PERSON TO DELIBERATELY DAMAGE ANY WEB SITE OR OTHERWISE CORRUPT THE CONTEST OR TO UNDERMINE THE LEGITIMATE OPERATION OF THE CONTEST MAY BE A VIOLATION OF CRIMINAL AND CIVIL LAWS. SHOULD SUCH AN ATTEMPT BE MADE, SPONSOR RESERVES THE RIGHT TO DISQUALIFY, PROSECUTE AND SEEK DAMAGES FROM ANY SUCH PERSON TO THE FULLEST EXTENT PERMITTED BY LAW.

    Sponsor reserves the right to void all votes made through any robotic, automatic, mechanical, programmed or similar entry duplication method and to disqualify any individual using such a method. If a Finalist is determined to be involved in such prohibited activity, s/he will be disqualified and will not be eligible to participate further for a chance to win the Grand Prize in this Contest.

  8. Disputes/Choice of Law: Except where prohibited, each entrant agrees that this Contest shall be governed by, and construed in accordance with, the laws of the State of Ohio, without giving effect to any choice of law or conflict of law rules. Sponsor reserves the right to take such action as it deems necessary to enforce these Official Rules and ensure the fair operation of this Contest, including without limitation barring entrants who do not comply with these Official Rules. By entering, entrants consent to the jurisdiction and venue of the appropriate federal, state and local courts located in Ohio for any and all disputes, claims and causes of action arising out of or connected with this Contest or any prize awarded.

  9. Winners List: For the names of the Finalists and the Grand Prize winner and/or a copy of the Official Rules, visit www.showusyourstyle.com. The Finalists' and Grand Prize winner's names will be posted after November 21, 2008 following the verification of Finalists/Grand Prize winner and the awarding of all prizes. You may also request a copy of the Rules or the Winners list by sending a self-addressed, stamped #10 business-size envelope to: Moen's "Show Us Your Style" Contest c/o Liggett Stashower, 1228 Euclid Ave., Cleveland, OH 44115. Indicate "Rules" and/or "Winner's List", as appropriate, on the front of your outer mailing envelope, in the lower left-hand corner. Mailed requests must be received by December 21, 2008.
